I had a brief look through your job postings, but fortunately saw nothing for Design UK. It's a highly unstable company that solves its problems by recklessly hiring-then-making-redundant over and over again. No serious developer should consider for a second working for an agency with a record of playing fast and loose with lives and careers like Design UK. Thanks, Ricardo. I'd like to ask you the favor of looking at my job postings for United Kingdom on my blog ricardo.parente.us and check if any of my postings are for such company. I'll be glad to insert a "CAUTION" note and a link to this post, if I had advertised for that company. I'm based in Winter Park, FL, but I post job openings from all over the world. Good luck, best regards, Ricardo. Dave,

Sad also that as a good employee you were shafted by a company that it would seem worked out the legalities before taking action, thus drawing upon your honesty to be dishonest themselves. I hope you get a much better job for lots more cash and that you build a good life for yourselves. Sorry not to say goodbye in person - but I'll keep up with your antics on F/book. For example, all it takes is a slight change in the job role & contract and it could easily be argued that they're offering a brand new position, which isn't the same as yours. It can be a hard one to disprove as well if they do take that approach and the job advert may not show you "the finer detail" :-( The legal process has a lot of get out clauses for companies when it comes to redundancy and (re)posting of positions.

I contacted one yesterday and just received a rather unfortunate response. Design UK knew exactly what they were doing and did it perfectly to evade legal action. I am ashamed of how I let myself be taken advantage of like this. "Dear Mr Knapik Thank you for your email query which has been referred to me to look into. Whilst I understand your frustration at being made redundant and expense/ problems you might have faced in arranging your move back to the US, I must advise at the outset that unfortunately, you are now out of time for making any application for unfair dismissal at the Employment Tribunal. The rules give an employee 3 months from the date of their dismissal to file any application to the Employment Tribunal with the particulars of claim. I understand that you were made redundant at the end of Sept 2009 - the deadline to make such an application expired in Dec 2009. Furthermore, if the deadline had not passed, you would need to be present in the UK in order to file your claim at the Employment Tribunal. I appreciate this might not have been the advice you were hoping to receive and wish you the best for the future." Thanks, Jonathon. And sorry i dont, must be a few lawyers specialized in redundancy? Really, Jonathon? I think I feel sick to my stomach. They knew full well that I was leaving the country, and they posted this on Monster a few days before that. Do you happen to know a good employment lawyer? I think I have a case. Wow. Really, Jonathon? I think I feel sick to my stomach. And they legally have to offer you your job back before they can offer it else where. Because they are technically making the job position redundant and not the staff member.
